These Terms & Conditions are entered into by and between you (“You” or “Individual Member”) and an independently owned and operated Keystone Collective Group (“Keystone Collective”, “KC Group”). Please read these Terms & Conditions carefully. By using the www.keystonecollective-group.com website and signing up to become a member of our Keystone Collective Group, You are agreeing to accept and be bound by, without modification or qualification, the terms, conditions, and notices contained herein.
If You do not agree to these Terms & Conditions, You should not use the Keystone Collective website and You should not sign up to become a member of our Keystone Collective group.
MODIFICATION OF THESE TERMS OF USE
Keystone Collective Group reserves the right to change the terms & conditions under which the Keystone Collective Group website and membership is offered, including but not limited to any changes that may be associated with the use of the Keystone Collective Group website.
Terms, conditions, fees & functionality of this website service are subject to change and availability, with limited advance notice.
NO UNLAWFUL OR PROHIBITED USE
As a condition of your use of the Keystone Collective Group Web Site, You warrant to Keystone Collective Group that You will not use the Keystone Collective Group Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Keystone Collective Group Web Site and all information contained in any manner which could damage, disable, overburden, or impair the Keystone Collective Group Web Site or interfere with any other party's use and enjoyment of the Keystone Collective Group Web Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available to You or provided for through the Keystone Collective Group Web Site.
CREATING AN ACCOUNT
To access our website, You will be required to create an account with a unique username, password, and nickname, which is for your personal use only. It is a condition of your use of the website that all information You provide to create an account is accurate and up to date.
Once registered, You are responsible for, and must treat your login information and member id# provided by Keystone Collective as confidential and agree not to create any duplicate accounts or use any account other than the account you created at initial registration. You agree to not choose a username and/or nickname that infringes on someone else’s intellectual property rights, identifies as a website other than our website, and contributes to any misleading action and/or status reflected on the website. Keystone Collective Group reserves the right to require changes to user credentials and has the right to disable any username, password, nickname or other identifier if, in our opinion, You have violated any provision of these terms of use.
MATERIALS PROVIDED TO KEYSTONE COLLECTIVE GROUP OR POSTED AT ANY KEYSTONE COLLECTIVE GROUP WEBSITE
Keystone Collective Group does not claim ownership of the materials You provide to Keystone Collective (including feedback and suggestions) or post, upload, input or submit to any Keystone Collective Group website or its associated services (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submissions, You are granting Keystone Collective Group, its affiliates and necessary sublicensees permission to use your Submissions in connection with the operation of their business(es) including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submissions; and to publish your name in connection with your Submissions.
No compensation will be paid with respect to the use of your Submissions, as provided herein. Keystone Collective Group is under no obligation to post or use any Submissions You may provide and may remove any Submissions at any time in Keystone Collective Group' sole discretion.
By posting, uploading, inputting, providing or submitting your Submissions, You warrant and represent that You own or otherwise control all the rights to your Submissions as described in this section including, without limitation, all the rights necessary for You to provide, post, upload, input or submit the Submissions.
Governing Law; Consent to Personal Jurisdiction; Waiver of Jury Trial. This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law provisions of any jurisdiction. To the extent that any lawsuit is permitted under this Agreement or in any way related to the subject matter of this Agreement, Keystone Collective and You hereby expressly and irrevocably consent to the personal jurisdiction and venue exclusively in the York County Court of Common Pleas of Pennsylvania or the Federal District Court for the Middle District of Pennsylvania. To the extent not prohibited by applicable law that cannot be waived, EACH PARTY HERETO IRREVOCABLY WAIVES ANY RIGHT TO TRIAL BY JURY IN ANY FORUM IN RESPECT OF ANY ISSUE, DEMAND, CLAIM ACTION OR CAUSE OF ACTION ARISING IN WHOLE OR IN PART FROM THIS AGREEMENT OR THE SUBJECT MATTER HEREOF.
Representations and Warranties. You warrant and represent that You have not signed a contract or agreement, or has any similar arrangement, with another individual or entity to provide combined energy pricing or any similar services as described herein, and that You are free to enter into and fully perform the terms and conditions of this Agreement, and that doing so will not result in the breach or default of any other agreement or contract to which You are a party.
No Chargeback Policy: If You decide to pay for membership utilizing a credit card, You agree that disputes of any nature may not be resolved by a credit card chargeback and further agree to refrain from filing any chargeback claim against Keystone Collective and/or its credit card merchant. By purchasing membership with Keystone Collective, the You waive the right to initiate a chargeback and furthermore agrees to pay a minimum of $500 plus administrative fees, costs, attorney fees, and/or any other charges associated with responding to said chargeback due to the administrative burden of responding to said dispute.
Waiver of Liability
Joining Keystone Collective requires accepting the following:
The maximum liability Keystone Collective holds is your membership fee. Keystone Collective is not responsible for fuel delivery, spills, member disputes, vendor issues, or any third-party errors, or any other reasons. You agree to indemnify and hold Keystone Collective harmless. You may still pursue damages from your vendor or insurance provider.
PROCESS:
We are a membership group. To state again, You agree to these terms and conditions with your signing up and paying your membership fee. Do not sign up if you do not agree.
We combine each member’s fuel needs to leverage the overall higher volume of the entire group, and negotiate a lower fuel price based on that higher combined volume.
We evaluate, negotiate and select from local energy suppliers of Propane, Heating Oil, and Kerosene, and provide the final pricing to each member.
A member has no obligation to accept our chosen supplier and/or Keystone Collective group pricing for your area. You can continue to obtain your energy and whatever price you would pay on your own. As an example, if you wish to join our group simply to learn our collective price points with target suppliers, and then do your own thing…..that is your choice. However, your membership fee is non-refundable. In addition, it is a bit disingenuous to other Keystone Collective members, plus the energy supplier, when you made a commitment to allow your energy VOLUME needs to be included in our group to obtain better pricing, and then not using our chosen energy supplier. We would appreciate a phone call discussion on this area if you choose NOT to participate after joining.
Depending on our members’ geographic locations required for energy needs, we will identify one or more energy suppliers for that location. The selection process involves supplier quality, customer service, delivery locations, and great bid pricing for our volume needs.
Our goal is to make very happy members through paying less money for energy. Over time, and based on member feedback, our selected suppliers may change. If a better supplier with lower pricing develops, we will notify all members in the affected locations. Energy supplier situations change as well, and a low-price supplier this year may not be the low-price next year.
Your feedback on energy supplier performance is very important to us. While switching suppliers is possible from one heating season to the next, the ability to switch suppliers within a given year may not be possible. There can be times when more than one supplier is available in a given location; however, swapping among them in the same heating season is problematic, and can only occur in unique circumstances. Please realize that energy suppliers are committing to annual volume energy needs as well, and to “unwind” volumes becomes very difficult. Members must contact us on this topic.
Timing for notification of chosen suppliers: On annual basis, this is usually in the summertime months around July/Aug. We will let all members know through email, and post updated information in the paid member’s section on our website. If something changes throughout other times in the year, we will try to let everyone know.
By accepting these terms, You agree to be contacted by Keystone Collective via email, post office, and phone (for urgent issues like account deletion or expiring fuel offers).
When energy suppliers are identified by Keystone Collective, what happens next: Each member/You must contact the assigned supplier directly, and provide your Keystone Collective Member ID#, name and address. With the energy supplier, You will choose type of annual service delivery plan, corresponding billing, and any tank needs such as inspections or swaps (if your tank is leased from another energy provider…see TANKS information.) Keystone Collective does not handle fuel payments; members do this directly with the energy supplier.
Heating Season
This is ultimately defined by your energy supplier and may vary each year. Typically, it runs from September 1 through the following May of the new year. Contact your assigned energy supplier for specifics.
Whether You fill your tank during summertime months is your decision along with your energy supplier. Since summer generally does not require home heating, and therefore minor fuel is consumed, the summertime is when individual member signup occurs and all member information is compiled by Keystone Collective. Keystone Collective evaluates/negotiates with energy suppliers for the next heating season during this time.
Note that individuals can sign up at any time of the year; it just helps our volume negotiations to have this information during the summertime months.
Fuel Types & Delivery
Keystone Collective is currently focused on Propane, Heating Oil, and Kerosene to obtain discounted pricing. All delivery, billing, and service is between You and your assigned energy supplier.
Refunds
Membership fees are non-refundable.
Here are some typical historical examples that members have asked about, but unfortunately do not enable a refund:
Member chooses to use a different fuel (different than identified at signup)
Member chooses not to use the Keystone Collective energy supplier
Member moves or sells their home, or changes apartments.
You do not pass a tank inspection, or fail a credit check, or energy supplier requirement for delivery.
You do not obtain an energy delivery, or miss a delivery due to personal/vendor issue
Refunds are only issued if we cannot arrange fuel delivery to your address. We encourage reviewing the site and FAQs before joining.
Vendor Communication & Energy Supplier Assignments
Generally, Pre-buy information and/or any Keystone Collective contract communications locked in with energy suppliers are released in timely periods throughout the year to comply with supplier requirements and to ensure supplier service quality. Communications may be sent in random sequential batches over a given time period.
Energy Supplier Policies
Energy Suppliers may discontinue service if You fail any credit checks, or pay late. See energy supplier policies.
Most energy suppliers require automatic delivery schedules. In addition, most energy suppliers will want to “top off” tanks in same general area during same routes to help reduce added delivery costs (and help our members save money).
Check with your energy supplier if You have questions about this.
Membership Rates
Residential: $45 for one home/one fuel. $20 for each additional location or fuel.
Business: $55 for one fuel/one location. $20 for extras.
Non-profits: $50 for one fuel/one location. $20 for extras.
